1. About these terms

These Terms of Service ("Terms") govern your use of the Humble Maintenance Care website at humblemaintenancecare.com.au and any services we provide through it, including our AI-assisted property assessment tool and chat assistant.

By using the website you agree to these Terms. If you don't agree, please don't use the site.

We are Humble Maintenance Care, ABN 42 502 587 550, based in Melbourne, Victoria, Australia.

2. AI assessment is a guide, not a quote

Our AI assessment tool gives you a quick, indicative read of the type and severity of property issue based on the photos or videos you submit. It is not a formal quote, engineering report, warranty or substitute for an on-site inspection by a qualified tradesperson. Final scope, pricing and recommendations will always be confirmed in writing after we inspect the site.

We do not accept liability for decisions you make based solely on an AI assessment without an on-site inspection.

3. Your photos, videos and content

By uploading photos or videos to us, you confirm that:

  • you own the content or have permission to share it;
  • you have permission of any people identifiable in the content;
  • the content does not infringe anyone else's rights or break any law;
  • you grant us a non-exclusive licence to use the content for the purpose of assessing your enquiry, delivering and recording your job, and improving our service quality.

You retain ownership of your content. We will not publish or share your photos or videos publicly (for example on our website or social media) without your separate written consent.

4. Quotes, jobs and invoicing

A quote becomes a contract once it is accepted in writing (including by email or by clicking "accept" in our system) and any required deposit is paid. The scope of work, pricing, GST, payment terms and warranty (if any) are set out in the quote we issue you. In the event of any inconsistency, the written quote prevails over content on this website or AI assessment output.

Invoices are issued via Xero and are payable in accordance with the terms shown on the invoice.

5. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Where we are permitted by law to limit our liability, our total liability to you for any claim arising out of or in connection with our services is limited, at our option, to re-supplying the services or paying the cost of having the services supplied again.

6. Acceptable use

You agree not to:

  • use the website or AI tool to upload unlawful, harmful, defamatory or infringing content;
  • attempt to disrupt, reverse engineer or gain unauthorised access to our systems;
  • use automated means to flood, scrape or abuse our endpoints;
  • impersonate another person or business.

We reserve the right to suspend access, throttle requests or refuse service if we believe these terms are being breached.

7. Third-party services

Our website relies on third-party services for AI processing, hosting, email, payments and accounting (including OpenAI, Anthropic, Resend and Xero). Their availability is outside our control. We are not liable for outages or limitations of those services.

8. Intellectual property

The website, our brand, content and software (other than your uploaded content and any third-party content) are owned by or licensed to Humble Maintenance Care. You must not copy, republish or commercially exploit any part of the site without our written permission.

9. Privacy

Your use of the site is also subject to our Privacy Policy, which explains how we collect and handle personal information.

10. Changes

We may update these Terms from time to time. The "Last updated" date at the top of this page shows when they were last changed. If you keep using the site after a change, you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of Victoria, Australia. The courts of Victoria have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.
